New defense presentations shed light on communications by colleagues of a quarter of students killed from the University of Idaho before the 911 call

CNN

New judicial presentations in the case of the Idaho University continue to complete the timeline of communications by two roommates of room survivors in the hours among four students died at home and when they called 911.

The brutal murders of the four students of the University of Idaho – Madison Mogen, Kaylee Goncalves, Xana Kernodle and Ethan Chapin -He took place in a residence outside the campus in Moscow in 2022. Bryan Kohberger He is accused of his murders, declared himself innocent and faces the death penalty in a trial that will begin in August.

In a judicial presentation published on Wednesday, Kohberger’s defense lawyers disagree with what they say is the selective use of state prosecutors of telephone records for surviving roommates, Dylan Mortensen and Bethany Funke, first thing in the morning of November 13, 2022.

They advocated that the judge prohibits that prosecutors show the selection of the prosecutor of the messages of the fourth partners to the jury, or that the judge allows more telephone records to be admitted in the trial so that the jury can see what they call a more complete image of what happened.

CNN previously reported that telephone records show that Mortensen and Funke exchanged panic text messages When they could not communicate with their other housemates at the time the researchers believe the Murders occurredBetween 4 am and 4:30 am

Mortensen sent a text message to Funke at 4:22, saying “No one is responding.” Funke says: “I already doubt WTF.”

Mortensen then sent a text message to Funke who saw what looked like a masked man at his home, saying: “I’m going crazy.”

Later, Funke sent a text message to Mortensen: “Come to my room” and “Run.”

The new defense presentation says that Funke agreed to Snapchat and Instagram shortly after the text exchange and called his parents hours later.

The records previously published in a motion by prosecutors suggested that Mortensen renewed their efforts to reach others at home around 10:23 am only after “waking up and realizing that he had not heard of his roommates.”

But Kohberger’s lawyers now say that Mortensen joined Funke in his room and his telephone activity was only dark for about three hours. According to the defense presentation, Mortensen’s telephone records show that he was awake before what prosecutors claim that he woke up.

The defense presentation reveals a series of telephone activity for Mortensen and Funke that was not previously made public.

Funke and Mortensen, identified by their initials in judicial documents, were using their phones around 8 am, the new defense presentation claims that Funke called his father’s phone at 7:30 am

The defense motion details the following call activity and access to social networks by the roommates, collecting hours after their text exchanges and Funke accessing Instagram at 4:37 am:

In the motion, Kohberger’s lawyers dispute the prosecution’s claims that Mortensen woke up to realize that his roommates had not responded to their text messages during the night.

Mortensen tried again to reach Goncalves and Mogen from 10:23 am, asking them if they were awake: “Are you?”

The new defense presentation says that Mortensen used Snapchat, Instagram and Tiktok and sent a text message to his father hours before he approached Mogen and Goncalves again.

Funke finally called 911 at 11:56 AM to inform Kernodle unconscious in the residence, according to the records, and two other friends with them could be heard in the call.

A transcription of the 911 call of the fellow survivors was also launched with a presentation earlier this month. Transcription shows chaos like Mortensen and Funke spend the phone between them responding to the dispatcher in fragmented responses.

The transcription does not identify the speakers by name, but shows another name without a name with them also spoke with the dispatcher. You can listen to great breathing and crying along the call. CNN obtained an audio recording of the call after the transcription was launched.

Prosecutors have indicated that they expect both survivors to testify at the trial and wish to use their text messages to illustrate the night line. Defensor lawyer Anne Taylor has pointed out what she described as inconsistencies In interviews of application of the law with Mortensen and Funke.

In the last presentation of the defense, Kohberger’s lawyer questions why the survivors’ fellow did not call 911 before.

“Despite her declared fear of leaving her room, she does it and joins BF on the ground floor. To get to BF’s room, DM passed through the main door of the residence. BF was steps from the main door. None of them left the house. None of them called friends, family or police to receive help,” says the presentation.

Kaylee Goncalves, Ethan Chapin, Xana Kernodle and Madison Mogen were killed on Sunday, November 13, 2022 outside the Idaho University campus.

The defense report was among the dozens of judicial presentations published on Wednesday, since the parties make their cases to the judge about what he should and should not be admissible evidence in the trial.

In another defense presentation published in the section, Kohberger’s lawyers say: “Many alternative perpetrators may be connected to the crime,” and have evidence that they want to show the court.

Prosecutors plan to call police witnesses to testify about a test they did to prove that it was possible to commit four homicides in a period of time of only minutes, including the time to walk and from a car and eliminate blood covered clothes, says a defense presentation.

Kohberger’s lawyers say they need an expert to testify about their development coordination disorder to show the jury that he was not physically able to commit the crime that argue that they required such speed and coordination.
