The bank found serious errors in the evaluation of the Superior Court and restored the Court award with slight modifications. The court said that the appellant, a truck driver and owner, was 57 years old at the time of the accident in 2012. Due to the amputation of his right leg, he suffered a 100% functional disability, which made him completely suitable for driving.

Although the MACT had taken this into account when granting ₹ 29.58 Lakh, the Superior Court reduced its 80% functional disability without assigning valid reasons and drastically reducing compensation. The Supreme Court observed that the Superior Court had not appreciated the registered evidence and had not provided convincing reasons for the substantive reduction.
