It is not mandatory to deposit an amount of 20 percent to present the appeal in checking cases: Superior Court of Delhi

The court heard a petition filed by an Anuj Ahuja, seeking to cancel the orders of the sessions by dismissing his statement of renouncing the requirement of depositing 20 percent as a condition to institute an appeal in the case of rebound.

Ahuja had taken a loan that was paid through two checks that were dishonored due to ‘Insufficient funds‘Banking account.

The lenders filed two complaints to the magistrate for each check. The magistrate found Ahuja guilty and condemned him.

In appeal, the session court suspended the orders of judgment of the magistrate, subject to Ahuja depositing 20 percent of the amount of compensation in each case.

Ahuja then submitted a request in search of a resignation to the condition, but the session court dismissed it.

Ahuja then moved the Superior Court against it.

Dr. Amit George Appearing for Ahuja said that such a requirement to present an appeal deprived Ahuja of his right to appeal, causing him a loss, damage and irreparable injuries.
